CAT Modifies Stay on Promotions in GMC Jammu, Bars Post-2016 Professors from Becoming Principals

Jammu, June 16 : The Central Administrative Tribunal (CAT) Bench at Jammu, comprising Member (Judicial) Rajinder Singh Dogra and Member (Administrative) Ram Mohan Johri, has modified its earlier order dated January 29, 2025, which had stalled promotions across all departments of Government Medical College (GMC), Jammu.
The fresh order came after Advocate Sheikh Shakeel Ahmed, representing ten aggrieved faculty members, argued that the initial blanket stay had unfairly halted promotions in unrelated departments. The applicants, who belong to various specializations like Orthopedics, Pediatrics, Medicine, and Anesthesia, claimed they were not heard before the stay was imposed based on a plea from three faculty members of the Radiation Oncology department.
Senior Advocate Abhinav Sharma, appearing for the original petitioners, contended that juniors to Dr. Rahul Sharma were promoted as Principals in various GMCs despite him being confirmed as Associate Professor in 2013, while others were confirmed after 2016.
After hearing arguments from both sides, the CAT Bench as per the news agency Kashmir News Trust, ruled that the J&K Government may proceed with promotions to Associate Professor and Professor levels at GMC Jammu. However, it restrained the government from appointing any Professor, confirmed by DPC/PSC after January 1, 2016, as Principal of GMC Jammu or through lateral entry in newly established medical colleges like GMC Doda, Kathua, Udhampur, Rajouri, or others.
