SRINAGAR: Jammu and Kashmir Police in Baramulla Saturday said it booked a 'hardcore instigator' and subsequently lodged him at Kot Bhalwal jail in Jammu. 

"Acting tough against ANEs Baramulla Police booked one person namely Nasir Ahmad Ganie son of Ghulam Mohammad Ganie resident of Raipora Palhallan Pattan under Public Safety Act after obtaining formal detention orders from the competent Authority", said a police spokesman in a statement issued to GNS. 

"The booked person has been detained and subsequently lodged in Central Jail Kot-Balwal Jammu", the spokesman said. 

"Pertinent to mention that the person is a hard-core Instigator  many cases are registered against him and was involved in the disturbance of L&O and subversion", the spokesman said adding "Despite his involvement in many FIRs he did not mend his anti national and (anti) social activities." (GNS)

SRINAGAR: The Jammu & Kashmir and Ladakh High Court on Monday quashed the preventive detention order of Kashmiri Journalist Asif Sultan under the Jammu & Kashmir Public Safety Act (PSA).

The Court directed administration to release him from preventive detention unless he is required in any other case.

Aasif Sultan, 36, was associated with the now closed magazine “Kashmir Narrator” when he was arrested in 2018. Sultan was arrested after police alleged that he worked for a banned militant group and booked under the Unlawful Activities (Prevention) Act (UAPA) and various other sections of the Ranbir Penal Code (RPC) – now the Indian Penal Code (IPC). Last year, he was booked under PSA.

Justice Vinod Chatterji Koul in its order issued on December 7, said the procedural requirements have not been followed and compled by the respondents in letter and spirit and resultantly, the impugned detention needs to be quashed.

The Court order read that perusal of impugned detention order reveals that on the basis of dossier placed before detaining authority by Senior Superintendent of Police, Srinagar , the detaining authority was satisfied that there are sufficient grounds to prevent detenu from acting in any manner prejudicial to the maintenance of security of the State, it was necessary to detain him under necessary provisions of law.
So, it is on the basis of dossier and other connected material/documents that impugned detention order has been passed by detaining authority,” the order read.

The Court said the grounds of detention, when looked into, give reference to case FIR No. 173/2018 to have been registered against detenu at Police Station Batamaloo, Srinagar .

“Involvement of detenu in the aforesaid case appears to have weighed with detaining authority, while making detention order. The detention record does not indicate that copies of aforesaid First Information Reports, Statements recorded under Section 161 Cr. PC and other material collected in connection with investigation of aforesaid case was ever supplied to the detenu, on the basis whereof impugned detention order has been passed. The aforesaid material, thus, assumes importance in the facts and circumstances of the case,” the order said.

In this backdrop, the Court opined that Sultan could not have been expected to make meaningful exercise of his Constitutional and Statutory rights , unless and until the material on which detention order is based, is supplied to him.

“It is only after detenu has all the said material available that he can make an effort to convince detaining authority and thereafter the Government that their apprehensions vis-à-vis his activities are baseless and misplaced,” the Court observed.

“If detenu is not supplied the material, on which the detention order is based, he will not be in a position to make an effective representation against his detention order. The failure on the part of the detaining authority to supply the material, relied at the time of making the detention order to the detenu, renders the detention order illegal and unsustainable,” the order said.
The court quashed his detention order.

“As a corollary, respondents are directed to set the detenu at liberty forthwith provided he is not required in any other case,” the order read. (UNI)

Police booked 54 most wanted and notorious drug smugglers under Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PIT NDPS) Act, and Public Safety Act (PSA) in Jammu Kashmir’s Baramulla district during the current year.

Baramulla police in its ongoing operation against drug smuggling and in order to eradicate the menace of drugs from society, has booked 54 drug smugglers under PIT- NDPS Act and PSA in the district after obtaining formal detention orders from the competent authorities and lodged in different jails of Jammu and Kashmir during the current year, a police statement said on Friday.

These hard-core drug peddlers were operating in Uri, Pattan , Baramulla, Kreeri and Tangmarg sub divisions of the district.

Pertinent to mention that many cases are registered against these drug Smugglers and were involved in promoting drug abuse trade by supplying drugs to local youth of in the district, police said and added despite their involvement in many FIR's they did not mend their activities and were again involved in promoting drug abuse trade by supplying drugs to local youth.

Sustained action against drug peddlers has brought a visible change in the ground situation and drug abuse has seen a considerable downfall in Baramulla district. Citizens have lauded the efforts of Police and have expressed their satisfaction and appreciation for the work of police.

Police urged the general People to come forward with the information of drug peddlers in their areas (identity will be kept confidential) in order to support police to eradicate the menace of drugs from the society. (UNI)

SRINAGAR: Police on Thursday detained one terrorist associate in Kishtwar district of Jammu and Kashmir.

Senior Superintendent of Police, Kishtwar, Khalil Poswal said that in a significant move aimed at safeguarding public safety and national security, Police as preventive measure detained a hardcore terrorist associate under the provisions of the Public Safety Act. (PSA)

The detained person was identified as Abdul Karim Butt, resident of Badhat Saroor, Tehsil Drabshalla, District Kishtwar, who happens to be brother of hardcore HM A++ category terrorist Jahangir Saroori, he said.

The SSP added that the detained terrorist associate was previously involved in anti national activities and accordingly was booked under provisions of UAPA Act who is facing trial in NIA court and his current activities are prejudicial to the security of the country and his free movements in the society also create circumstances to radicalise youth.
Accordingly the subject has been detained under PSA and lodged at District Jail Kishtwar, he added.

The Public Safety Act empowers law enforcement agencies to take necessary measures to counter potential security risks and maintain the safety of the community, said the SSP adding that police is committed to upholding the rule of law while ensuring that civil liberties are respected.
Poswal emphasized that the police force is employing a multi-pronged approach to address the issue of anti-national elements.

Alongside organizing awareness programs to educate the public, the police will not hesitate to take stern actions against those disrupting peace and harmony, he said.
The SSP issued a stern warning to all Over Ground Workers (OGWs) and anti-national elements, stating that Kishtwar will not tolerate any activities that threaten the security of our nation.

He urged them to return to the path of peace and urged the public to support the police in maintaining a safe and secure environment.

SRINAGAR: J&K police on Thursday booked three persons in North Kashmir under stringent Public Safety Act (PSA) for their alleged anti-national and anti-social activities.

Police said the trio were booked under PSA in Baramulla and Bandipora districts of Jammu and Kashmir after obtaining formal detention orders from competent authority.

Police said in Baramulla Tanveer Ahmad Khan of Taripora Sheeri was booked under PSA for his involvement in anti-national activities . The booked person has been detained and subsequently lodged in District Jail Kathua.

In Bandipora, police booked two persons under PSA for their involvement in anti-national and anti-social activities.

The duo identified as Hilal Ahmad Parray of Kochak Mohalla Hajin and Abdul Hameed Parray of Syed Mohalla Hajin have been lodged in Central Jail Kot Balwal Jammu.

"Many cases were registered against them and were involved in anti-national/anti-social activities.

Despite their involvement in many FIRs, they did not mend their anti-national/anti-social activities and were again involved in such types of activities," a police spokesman said.

Moreover, police in Baramulla said that they booked a notorious drug smuggler identified as Irfan Rasool Lone alias Danish of Fatehgarh Sheeri under PIT-NDPS Act after obtaining formal detention orders from the competent authority.

The booked drug smuggler has been detained and subsequently lodged in Central Jail Kot-Balwal Jammu. (UNI)

SRINAGAR: Jammu and Kashmir Police on Friday booked a former militant and member of APHC under Public Safety Act (PSA) in north Kashmir’s Bandipora district. 

Bandipora police in a Tweet, as per the news agency, Kashmir News Observer (KNO) said that  Ameer Hamza, an ex-militant, from Quilmuqam village was involved in anti-national activities. 

"Bandipora Police booked one ex terrorist & member of APHC namely Ameer Hamza Shah R/o Quilmuqam Bandipora under PSA and lodged him in District Jail Baramulla, for his continuous involvement in anti National activities," police tweeted. (KNO)

SRINAGAR: Police on Saturday said that it booked three militant associates under the Public Safety Act owing to their involvement in supporting militancy.

In a handout GNS, the police said that three militant associates were booked under PSA for supporting militancy.

The police spokesman identified them as Umer Ahmad Ganaie son of Gh Mohd Ganaie resident of Setthergund Kakapora, Aftab Hussain Dar son of Ab. Gani Dar resident of Avangund Rajpora and Hilal Ahmad Khan son of Mohd Anwar Khan resident of Hakhripora.

They have been identified as active OGWs and facilitator of different militant organizations of LeT/TRF/JeM etc. They were also involved in facilitating the movement of militants, providing them transport facilities, engaging in anti-national activities that poses a threat to the region's security, he said.

Stringent action shall be taken against all those involved in any militant activity, reads the statement.(GNS)

SRINAGAR: Police on Tuesday booked three men in Jammu and Kashmir’s Baramulla district under stringent Public Safety Act (PSA) for their alleged involvement in anti-national activities.

Mohammad Ashraf Mir of Wussan Pattan, Mohammad Yaseen Bhat of Tapper Pattan and Wasid Ashraf Sofi of Watergam Wagoora were booked under PSA after obtaining formal detention orders from the competent Authority, police said.

Under the PSA, a detainee can be held for two years without trial.

The trio were detained and subsequently lodged in District Jail Udhampur, Central Jail Kot-Bhalwal Jail Jammu and District Jail Kathua respectively, they said.

Police said that many cases are registered against these persons and were involved in anti-national activities.

SRINAGAR: A fraudster from Srinagar has been arrested and booked under PSA for fraud, human trafficking and child labour and cheating.

Srinagar police in a tweet as per the news agency, Kashmir Scroll said that one fraudster identified as Rizwan Ahmad Shah of Safakadal Srinagar, Owner of Shah Ji Consultancy, Rajbagh haa been booked in PSA and lodged in Kot Balwal Jail. He had done fraud, human trafficking, child labour, cheating, police said, adding that public is advised to check credentials of consultancies for hiring domestic helps.

SRINAGAR; Police in central Kashmir's Srinagar district executed PSAs against three notorious thieves in the district on Monday.

A senior police officer told news agency, Kashmir Scroll that three notorious thieves have been slapped with the PSA, including Imtiyaz Ahmad Shiekh, son of Ghulam Qadir Shiekh, a resident of Alimir Khanyar; Mohammad Shameem Boya, alias Mamoon Boya, son of Mohammad Mamoon, resident of Kolkata, Ulberia, West Bengal, at present Tengpora Bypass Sringara; and Mohammad Hilal Shiekh, son of Mohammad Batoo Shiekh of Chardarwaza Bazbadanpora Iman Chowk Jaipur Rajasthan at present Maisuma.

The officer said all three were lodged in the central jail in Kot Bhalwal, Jammu. It is pertinent to mention here that all three were notorious criminals and were involved in many big robberies in parts of Kashmir the officer added.(KS)

SRINAGAR: Four residents of Jammu and Kashmir’s Baramulla district have been booked under stringent Public Safety Act (PSA) for their alleged anti national activities, police said.

The PSA allows detention without trial for a year. A police statement issued to the news agency, Kashmir Scroll that four persons hailing from various areas of Pattan Baramulla were booked under PSA for being involved in anti- national activities.

They were subsequently detained and lodged in Kot-Bhalwal jail in Jammu. The four were identified as Javaid Hussain Yatoo of Goshbugh Pattan; Jan Nisar Khaliq Ganai of Chanderhama Pattan, Abid Parvaiz Hajam of Andergam Pattan and Nisar Ahmad Wani of Sultanpora Pattan.

Police said many cases were registered against these persons and were involved in anti-national activities. “Despite their involvement in many FIR’s they did not mend their anti national activities,” Police said.
